These are the terms that govern your use of playacr.com and any concierge services we provide. Please read them carefully. By using this site or engaging our concierge service you agree to these terms.
1. About PlayaCR
PlayaCR — a Costa Rica concierge service operated by Rob & Jenny Cosman in Tamarindo, Guanacaste, Costa Rica. We operate as a concierge referral service. We help travelers plan trips to Costa Rica’s Pacific Guanacaste coast and we coordinate bookings on their behalf with independent local operators (villa owners, fishing captains, catamaran operators, private chefs, spa providers, transport operators, etc.).
PlayaCR does not own, operate, manage, or control the boats, vehicles, villas, restaurants, spas, equipment, or staff associated with the experiences described on this site. Those are owned and operated by independent third parties. We exercise reasonable care in vetting them, but the experience itself is between you and the operator.
2. Acceptable use of the site
You agree to use playacr.com for personal, non-commercial trip planning. You agree not to:
- Scrape, mirror, frame, or redistribute the site’s content without our written permission
- Use automated tools to access the site (other than legitimate search engine crawlers)
- Reverse-engineer the site or attempt to gain unauthorized access
- Submit false information through our forms
- Use the site for illegal activity
3. Concierge service – how it works
- You contact us with your trip preferences via a form, email, or messaging
- We propose operators, dates, and experiences and quote pricing
- If you confirm, we coordinate the booking – either by introducing you directly to the operator, by booking on your behalf with the operator, or (occasionally) by collecting payment on the operator’s behalf
- The actual service – the fishing day, the villa stay, the catamaran charter – is delivered by the operator under their own terms, waivers, and policies
- You are responsible for reading and agreeing to the operator’s own terms of service, waivers, insurance requirements, and cancellation policies
4. Pricing & payment
- For most experiences we facilitate, you pay the operator directly. The operator pays us a referral fee out of their margin – you do not pay extra for engaging us.
- For some bookings (notably some villa stays), we may collect payment on the operator’s behalf and forward it. In those cases, the operator’s refund and cancellation policies apply.
- Deposits are typically non-refundable per the operator’s policy. We will tell you the cancellation terms before you commit.
- All prices on the site are illustrative unless we send you a specific written quote. Final pricing depends on date, group size, season, and operator availability.
5. Weather, cancellations, and force majeure
Costa Rica’s Pacific coast has reliable dry-season weather (December – April) but occasional cancellations happen, particularly during green season. If an operator legitimately cancels for weather, mechanical, or safety reasons, we will work to rebook the experience during your trip when possible. Refunds for weather cancellations follow the operator’s policy. PlayaCR is not liable for losses resulting from weather, force majeure, government action, illness, or other circumstances outside our reasonable control.
6. Limitation of liability
To the maximum extent permitted by applicable law:
- PlayaCR provides this site and concierge service “as is” and “as available.” We make no warranties (express, implied, statutory, or otherwise) about the site, the information on it, or any experience booked through us, including (without limitation) warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
- PlayaCR is not liable for any injury, loss, damage (including property damage, personal injury, illness, or death), expense, or claim arising from any experience operated by a third-party operator (fishing charter, catamaran, villa stay, restaurant meal, spa session, transport, etc.). Liability for those experiences rests with the operator.
- PlayaCR is not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages – including lost profits, lost vacation time, lost opportunity, or emotional distress – arising from the site or our concierge service.
- To the maximum extent permitted by law, PlayaCR’s aggregate liability for any claim arising from a specific booking shall not exceed the fees actually received by PlayaCR in connection with that booking (which is typically zero for the traveler, as we are paid by operators).
Some jurisdictions do not allow limitation of certain damages. In those jurisdictions our liability is limited to the maximum extent permitted by applicable law.
7. Indemnification
You agree to indemnify, defend, and hold harmless PlayaCR, its operators, and its agents from any third-party claim, demand, loss, or expense (including reasonable attorneys’ fees) arising from: (a) your use of the site, (b) your conduct during any booked experience, (c) your violation of these Terms, (d) your violation of any third party’s rights, or (e) any false information you provided.
8. No professional advice
We are not licensed travel agents, doctors, lawyers, insurance brokers, or financial advisors. Content on the site is informational and reflects our personal experience on the Guanacaste coast. You are responsible for your own travel insurance, medical preparation, visa compliance, and any other arrangements not specifically booked through us.
9. Intellectual property
The text, photographs, layout, and original content of playacr.com are the intellectual property of PlayaCR (or used with permission from contributing operators or stock providers). You may not reproduce, republish, modify, or distribute this content without our written permission. Brief quotation with attribution is permitted.
10. Third-party content and links
Our site contains links to third-party sites (operator websites, social media, Google Maps, partner properties). PlayaCR is not responsible for the content, policies, or practices of those sites. Your use of any linked site is subject to that site’s terms and privacy policy.
11. Governing law and disputes
These Terms are governed by the laws of the Republic of Costa Rica. Any dispute arising from or relating to these Terms or your use of playacr.com shall first be addressed informally by the parties for a period of at least 30 days. If unresolved, the dispute shall be resolved in the competent courts of Guanacaste, Costa Rica, which the parties accept as the exclusive forum.
12. Changes to these Terms
We may update these Terms from time to time. Updates take effect when posted; the “Last updated” date at the top of this page indicates the version. Material changes will be highlighted on the site. Continued use of playacr.com after an update means acceptance.
13. Miscellaneous
- Severability: if any provision of these Terms is held unenforceable, the remaining provisions remain in full effect.
- No waiver: our failure to enforce a provision is not a waiver of our right to enforce it later.
- Entire agreement: these Terms (with our Privacy Policy and Cookie Policy) are the complete agreement between you and PlayaCR regarding the site.
- Assignment: you may not assign these Terms. We may assign them in connection with a business transfer.
